The list of evidence an operator may show an officer includes an image displayed on a wireless communication device that is provided by a liability insurer.1 Texas law says an operator who does not exhibit evidence of financial responsibility on request is presumed to have violated the insurance requirement, unless the officer verifies coverage through the state verification program.1 Texas law directs the Texas Department of Insurance to establish a program to verify whether vehicle owners have established financial responsibility.2
If a person has a previous conviction, the offense is a misdemeanor punishable by a fine of $350 to $1,0003. The Department of Public Safety (DPS) may waive the requirement to maintain evidence of financial responsibility if satisfactory evidence shows the person was in compliance at the time of arrest.4
A personal auto policy written for a term of less than 30 days5 may not be used to obtain a driver’s license, registration or plates, or an inspection certificate.
